These terms explain how NowExpress works, what you can expect from us and our healthcare partners, and what we need from you when you use the website or purchase a product or service.
1. When These Terms Apply
These Terms and Conditions apply to nowexpress.ph, NowExpress assessments, doctor reviews and consultations, prescription workflows, medicines and wellness products, diagnostic bookings, payments, deliveries, follow-up, and support.
By selecting an unchecked acceptance box, placing an order, booking a service, or otherwise taking the clear acceptance step shown to you, you agree to the version displayed at that time. We record the applicable version, date and time, and transaction reference. Merely visiting a public page does not by itself mean you consent to health-data processing or telehealth.
A service-specific policy or consent may add to these terms. If two provisions conflict, the more specific rule for that product or service controls for that issue. Mandatory patient, privacy, and consumer rights always control.
2. Important Medical and Emergency Notice
Do not use NowExpress for an emergency. Call 911 or go to the nearest emergency department if you have severe chest pain, difficulty breathing, signs of stroke, loss of consciousness, severe bleeding, a severe allergic reaction, thoughts of harming yourself or another person, or another urgent or rapidly worsening condition.
Website articles, product pages, questionnaires, calculators, and automated messages are general information or screening aids. They are not a diagnosis and do not replace a licensed professional's judgment. A clinician may require an in-person examination, test, referral, or emergency care before giving advice or prescribing.
3. Who May Use NowExpress
You must be at least 18 and legally capable of entering a contract to place an order. You must use your real identity and provide accurate information. You may not purchase a prescription medicine for another person or transfer a patient-specific prescription, consultation, or diagnostic booking unless the service expressly permits an authorized representative and the required authority is verified.
A minor may receive only a service that NowExpress and the responsible provider make available to minors, with a parent, guardian, or other legally authorized representative involved as required. Some products and services have additional age, location, health, prescription, or identification requirements.
4. The Roles of NowExpress and Healthcare Providers
NowExpress is operated by NowServing Healthcare Corporation, which holds Food and Drug Administration Licenses to Operate as a Drugstore, as a Drug Distributor–Wholesaler, as a Medical Device Distributor–Retailer/Wholesaler, and as a Food Distributor–Wholesaler. NowExpress provides online pharmacy services under its Drugstore licence. The licensed legal entity and the role that applies to your transaction are shown in the relevant checkout, receipt, product, or service information.
NowExpress is directly responsible for the regulated work it performs. This includes pharmacy supervision, prescription validation and recording, dispensing, labeling, counseling, medicine integrity, lawful sourcing, storage, transport and distribution controls, product traceability, quality-complaint handling, adverse-event escalation, device-incident handling, and recalls, as applicable to the order. Distributor and wholesaler status supports the supply chain; it does not turn a retail patient order into a wholesale transaction or reduce your consumer rights.
A licensed doctor is responsible for the doctor's medical judgment, including whether telemedicine is suitable, what information or examination is needed, whether to diagnose or refer, and whether to issue, change, or decline a prescription. No purchase or questionnaire guarantees a prescription or a particular clinical result.
A NowExpress pharmacist is professionally responsible for the pharmacy work the pharmacist performs. If a particular confirmation identifies another licensed pharmacy as the dispenser, that pharmacy and its pharmacist are responsible for their dispensing work, while NowExpress remains responsible for its own merchant, coordination, distribution, privacy, and other legal duties. A licensed diagnostic laboratory or facility is responsible for specimen collection, test performance, quality control, and the result it issues.
NowExpress remains your point of contact for a NowExpress order or booking and will coordinate with the responsible partner. Referring a matter to a partner does not remove a responsibility that NowExpress has under your transaction or Philippine law.
5. Your Information and Security
- Provide complete, current, and truthful health, prescription, payment, and delivery information.
- Keep one-time codes and order or booking references private, unless an approved representative process applies.
- Tell us promptly if you suspect unauthorized access, an incorrect patient record, or use of your identity.
- Do not place duplicate or multiple orders to avoid safety controls, purchase limits, eligibility checks, or a prior clinical decision.
- Review important service, safety, result, recall, and delivery messages sent to the contact details you provided.
We may decline or restrict an order to protect a patient, investigate suspected fraud or unauthorized access, comply with law, or prevent misuse. Where reasonably possible, we will explain the decision and how to ask for review. A restriction does not erase an existing refund, privacy, record-access, or complaint right.
6. Electronic Communications, Signatures, and Records
You agree that orders, notices, disclosures, prescriptions, invoices, results-routing notices, policy acceptance, and consent may be created and delivered electronically where law permits. An electronic checkbox, code, typed confirmation, or other method is effective only when the flow clearly identifies the action and records your affirmative choice.
Keep your email address and mobile number current. You may request an accessible copy of an applicable policy, consent, invoice, or transaction record. Electronic acceptance of these terms does not replace a separate consent required for telehealth, sensitive health information, optional recording, marketing, or future recurring billing.
For prescriptions dispensed by the NowExpress pharmacy, the pharmacy keeps the patient medication profile and prescription recording system for at least two years after the last entry, as required by the Philippine Pharmacy Act. Other regulated pharmacy or distribution records may follow different or longer legal periods.
7. Health Assessments and Information You Provide
Answer health questions completely and honestly. Tell the clinician about symptoms, diagnoses, allergies, pregnancy or breastfeeding, medicines, supplements, recent tests, and other facts relevant to the service. Incomplete or false information can make online care unsafe and may lead to delay, referral, cancellation, or refusal of a product or service.
An online assessment may flag possible eligibility, but it is not approval. Eligibility can change after professional review, identity checks, prescription validation, stock checks, laboratory requirements, or new health information.
8. Telehealth and Doctor Review
Before telehealth begins, we will identify the type of interaction, the responsible provider, material limitations, fees, privacy practices, and alternatives, and obtain the separate Telehealth Informed Consent and Patient Authorization required for that interaction.
A doctor may stop an online review or consultation and direct you to in-person or emergency care. Technical failure, the absence of a physical examination, incomplete information, or the seriousness of a condition may prevent a safe decision. You may also stop a consultation and request in-person care.
A completed professional review or consultation is not unsatisfactory merely because the doctor does not prescribe, changes the requested medicine, asks for tests, or recommends in-person care. The Refund, Return, and Cancellation Policy explains when a fee may still be refunded or rebooked.
9. Prescriptions, Medicines, and Medical Devices
- Prescription medicines are supplied only after a valid prescription and the required clinical and pharmacy checks.
- The doctor decides whether a prescription is clinically appropriate. The pharmacist may contact the prescriber, request clarification, decline to dispense, or refer an issue when pharmacy law or patient safety requires it.
- You must use a medicine only for the named patient and follow the prescription, label, storage instructions, and professional advice.
- Do not share, resell, alter, or use another person's prescription medicine.
- Contact a doctor or pharmacist promptly about unexpected side effects, dosing questions, damaged packaging, suspected falsification, or a recall. Seek emergency care for a severe reaction.
Product photographs and packaging may change. The delivered product must still match the confirmed medicine, active ingredient, strength, dosage form, quantity, prescription, and applicable product information. We will contact you before making a material substitution that requires your or the prescriber's agreement.
A medical device is supplied only within the authorization applicable to NowExpress and the product. Use it only for its intended purpose and follow the manufacturer's label, instructions, storage conditions, warnings, cleaning or calibration requirements, and any professional advice. A device listing or sale is not a diagnosis and does not guarantee that the device is suitable for every patient or will produce a particular clinical result.
Do not use a sterile, single-use, implantable, diagnostic, measuring, or other device if the packaging, seal, expiry, calibration, or condition appears compromised. Report a malfunction, inaccurate or unexpected reading, injury, contamination concern, missing instructions, falsification concern, or recall promptly. NowExpress will investigate the distribution and sale it performed, preserve traceability, coordinate with the manufacturer or authorization holder where needed, and make any report or recall action required by the Philippine FDA.
10. Birth Control
Birth Control services are for adults who complete the required health assessment and receive review by a licensed clinician. Tell the clinician about pregnancy or possible pregnancy, breastfeeding, allergies, smoking or nicotine use, migraine, blood pressure, blood-clot or cardiovascular history, liver disease, current medicines, and any other requested safety information.
A requested brand, formulation, strength, method, or quantity is not guaranteed. The clinician may ask questions, require blood pressure or tests, recommend another option, change or decline the requested treatment, or direct you to in-person care. A prescription has the validity and refill limits stated by the prescriber and applicable law.
Injectable or procedure-based contraception may require scheduling and administration by an appropriately qualified provider at an approved location. Buying a product does not mean NowExpress will permit unsupervised administration where professional administration is required.
No contraceptive method is guaranteed to prevent pregnancy, and ordinary hormonal or barrier contraception does not protect against sexually transmitted infections unless the product specifically provides barrier protection. Seek urgent care for severe symptoms and ask the clinician what to do after missed doses, vomiting, medicine interactions, or suspected pregnancy.
11. Men's Health, Including Erectile Dysfunction
Men's Health prescription services, including erectile dysfunction treatment, are for adults who verify identity, complete the required medical assessment, and receive clinician review. Disclose cardiovascular disease or symptoms, blood pressure concerns, fainting, stroke history, kidney or liver disease, eye conditions, allergies, all medicines and supplements, and any use of nitrates, nitric-oxide donors, recreational nitrites, or other treatments the assessment asks about.
The requested product, strength, quantity, refill, or outcome is not guaranteed. The clinician may modify the request, ask for clarification or testing, apply quantity or refill limits, require video or in-person assessment, refer you, or decline treatment. The pharmacist performs separate prescription and safety checks.
Do not combine treatments or change a dose unless a clinician says it is safe. Seek emergency care for chest pain, fainting, severe allergic symptoms, sudden vision or hearing loss, an erection lasting longer than four hours, or another severe or rapidly worsening symptom.
12. Weight Care
Weight Care is for adults who complete the required assessment and any consultation, identity verification, measurements, laboratory tests, or follow-up required for safe care. Eligibility is ongoing, not permanent.
The clinician controls diagnosis, eligibility, medicine choice, dose, titration, monitoring, continuation, pause, and discontinuation. Tell the clinician promptly about pregnancy, possible pregnancy, plans to become pregnant, breastfeeding, new medicines, surgery, severe or persistent side effects, dehydration, material health changes, or another warning the care plan identifies.
NowExpress does not guarantee eligibility, a prescription, a particular medicine or dose, continuous supply, a specific amount or rate of weight loss, or another outcome. A refill or reorder may require updated measurements, answers, laboratory tests, consultation, or a new prescription. Dose changes can change the price, and we will show the difference before charging or fulfillment.
If treatment is paused or stopped for safety, or stock is unavailable, we explain available clinical and commercial next steps. We do not substitute a prescription medicine without the prescriber's approval and your agreement where needed. Cold-chain medicines are subject to the Cold-Chain Product Terms and require prompt receipt and labelled storage.
A Weight Care purchase is one-time unless checkout clearly identifies a recurring plan and you separately authorize it. Any future recurring plan must disclose billing, renewal, cancellation, included benefits, failed payments, stock shortages, unused services, and what happens if treatment becomes clinically inappropriate.
13. Diagnostic Services
The Diagnostics Terms, Booking, Rebooking and Refund Policy forms part of these terms for a diagnostic order. NowExpress coordinates the order; the selected licensed laboratory or facility performs the test or procedure.
- A diagnostic order is currently valid for 60 days from purchase.
- You may cancel for a full refund within 48 hours from purchase or before the scheduled appointment begins, whichever comes first.
- You may request up to two customer-initiated rebookings, subject to availability. Each confirmed rebooking creates a new 60-day validity period from the confirmed appointment date.
- An order that expires because you did not use it is generally not refundable, subject to provider-side failure, circumstances beyond your reasonable control, and rights under law.
- If NowExpress or the laboratory cannot provide the service for a reason not attributable to you, the remedy may include rebooking, an equivalent service, recollection at no cost, or a refund.
The product and confirmation identify whether the service is walk-in, scheduled, schedule-dependent, or home service. Imaging and selected procedures may require branch confirmation, a preferred date and backup dates, an LOA, endorsement, order ID, prescription or doctor's request, and additional clinical or administrative requirements.
Follow preparation instructions and bring required identification, prescription, request, guardian, or authorization. If an undisclosed laboratory requirement materially prevents the service, the provider-side remedy rules apply. Home service requires a confirmed address, safe access, and patient availability.
Results are released through the channel and estimated readiness stated for the test and partner laboratory. A turnaround estimate is not a guarantee where specimen quality, confirmation, recollection, or another laboratory process affects release. Medical interpretation or a doctor consultation is not included unless your order expressly says it is. HMO or insurance coverage is not included unless expressly confirmed.
14. HIV Self-Test Kits
An HIV self-test kit is a regulated medical device supplied for use by the person being tested. It is a screening test, not a diagnosis. A reactive result must be confirmed by a licensed facility using the confirmatory testing algorithm applied in the Philippines, and a non-reactive result does not exclude infection during the window period after possible exposure.
Follow the manufacturer's instructions, expiry date, storage conditions, and reading time exactly. Do not use a kit if the pouch, seal, or contents appear damaged, or if the expiry date has passed. An incorrectly performed or incorrectly timed test can produce a wrong result.
If your result is reactive, or if you are unsure how to read it, seek confirmatory testing and counselling from a DOH-accredited treatment hub, social hygiene clinic, or another licensed facility. NowExpress can point you to available services on request. Confirmatory testing, counselling, and treatment are not included in the purchase of a kit unless your order expressly says so.
HIV information is confidential under the Philippine HIV and AIDS Policy Act. NowExpress does not require you to report your result to us, does not record a self-test result as part of your order, and will not disclose HIV-related information except as that Act and the Data Privacy Act permit.
A self-test kit is not returnable once the pouch is opened. Report a suspected device defect, missing component, unreadable result window, or damaged packaging promptly so we can investigate and, where required, report to the Philippine FDA.
15. Orders, Acceptance, and Availability
Submitting an order is an offer to purchase. An automated email or page confirms that we received it; it does not always mean the order has been finally accepted. Acceptance may depend on payment, identity checks, clinical approval, a valid prescription, pharmacist review, laboratory confirmation, stock, service area, delivery capacity, and fraud review.
If we cannot accept or fulfill a paid order, we will explain the affected part and provide the applicable rebooking, replacement, credit chosen by you, or refund. We will not substitute a materially different medicine, test, branch, schedule, or paid service without notice and any agreement required.
We may set reasonable quantity or frequency limits for patient safety, prescription compliance, stock fairness, fraud prevention, or law. Limits must not be used to avoid an accepted obligation or statutory benefit.
16. Prices, Payment, and Receipts
Prices are in Philippine pesos unless stated otherwise. Before payment, checkout shows the product or service price, consultation or professional fee, diagnostic fee, delivery or home-service fee, taxes, discounts, and total. The confirmed checkout price applies to the accepted order, except that we will contact you about an obvious system or pricing error before proceeding. You may cancel the affected item for a full refund if you do not accept the corrected price.
You authorize the displayed one-time charge when you submit payment. A failed, reversed, duplicated, underpaid, or overpaid transaction may require another payment request or a correction. We provide an electronic order confirmation and the invoice or receipt required for the transaction.
Unless checkout clearly identifies a recurring plan and you separately authorize it, a NowExpress purchase is one-time. Completing an assessment or one-time purchase does not enroll you in automatic billing. Any future recurring plan must disclose the amount or calculation, frequency, renewal date, included services, cancellation method, and treatment of charges already processed.
17. Senior Citizen and PWD Benefits
Eligible senior citizens and persons with disability may claim the discounts and VAT exemptions required by Philippine law for qualifying medicines and health services purchased online. You must provide the qualifying ID and other legally required documents through the approved process. We collect only what is reasonably needed to verify and record the benefit.
The benefit applies only to eligible components and the qualified person's own purchase or service. Delivery, convenience, home-service, or other non-covered fees are not discounted unless law requires it. If a valid benefit was missed or calculated incorrectly, contact support so we can investigate and correct the transaction.
18. Shipping and Delivery
Delivery methods, fees, areas, and estimates are shown at checkout or confirmation. Prescription orders are processed only after the required doctor and pharmacy approvals. Estimates are not guarantees because traffic, weather, courier capacity, address access, patient contact, clinical review, stock, and safety checks can affect timing.
Provide a complete address, reachable mobile number, and authorized adult recipient. Inspect the parcel promptly. Plain external packaging protects privacy, but legally or operationally required recipient, address, courier, and handling labels may appear. For an item identified as requiring controlled-temperature handling, the active Cold-Chain Product Terms form part of these Terms and provide the specific receipt, storage, failed-delivery, assessment, return, and recall rules.
NowExpress remains your support contact for the order even when a third-party courier is used. A courier delay does not automatically create liability for every consequence, but it also does not remove a remedy for loss, damage, non-delivery, unsafe handling, or another failure covered by law or policy.
19. Cancellations, Returns, Replacements, and Refunds
The Refund, Return, and Cancellation Policy explains the rules by product and service. In summary, a change-of-mind return may be restricted for prescription, opened, used, personalized, perishable, or cold-chain products. Those restrictions do not apply to a wrong, defective, damaged, expired, recalled, unsafe, materially misdescribed, or undelivered item, or to an imperfect or unprovided service where law provides a remedy.
Do not return a medicine or cold-chain item without instructions. Keep the item, packaging, label, receipt, and available evidence and contact us promptly. Approved refunds are generally sent to the original payment method; store credit will not replace a refund required by law unless you freely choose it.
19. Safe Use and Follow-Up
Read the label and patient information, follow storage and preparation instructions, attend required monitoring, and contact the relevant clinician, pharmacist, or laboratory with questions. Do not ignore worsening symptoms because an online order or consultation is pending.
Tell us promptly about a suspected product defect, tampering, temperature problem, adverse event, dispensing error, incorrect result record, or recall. We may ask for relevant photographs, batch details, records, or return of a product for investigation, but evidence requests will be proportionate and will not require unsafe handling.
20. Safe Use and Follow-Up
Read the label and patient information, follow storage and preparation instructions, attend required monitoring, and contact the relevant clinician, pharmacist, or laboratory with questions. Do not ignore worsening symptoms because an online order or consultation is pending.
Tell us promptly about a suspected product defect, tampering, temperature problem, adverse event, dispensing error, incorrect result record, or recall. We may ask for relevant photographs, batch details, records, or return of a product for investigation, but evidence requests will be proportionate and will not require unsafe handling.
21. Acceptable Use
You must not:
- Use NowExpress for fraud, impersonation, forged prescriptions or IDs, resale, unlawful diversion, or another illegal purpose.
- Give intentionally false clinical information or conceal information to obtain a medicine or service.
- Try to bypass age, prescription, quantity, payment, security, or clinical-safety controls.
- Access another person's order or records without authority.
- Upload malware or unlawful, infringing, abusive, or harmful material, or interfere with the website or its providers.
- Record a teleconsultation without the doctor's consent and any other consent required by law.
We may investigate and take proportionate action, including refusing or cancelling an affected transaction, restricting access, preserving evidence, and reporting suspected unlawful conduct when authorized or required. We will not use this section to suppress a good-faith complaint, review, privacy request, or patient-safety report.
22. Content and Intellectual Property
NowExpress and its licensors own or lawfully use the website design, software, text, graphics, trademarks, and other protected content. You may use public patient information for your personal, non-commercial healthcare purposes. You may not copy, sell, scrape, modify, publish, or exploit protected content or software except as law permits or we authorize.
You keep ownership of material you submit. You authorize NowExpress and the relevant providers to host, reproduce, transmit, and use it only as reasonably needed for the service, safety, records, legal duties, and other purposes explained in the Privacy Policy. This permission does not authorize unrelated advertising use.
23. Third-Party Services and Availability
NowExpress depends on healthcare providers, Shopify, payment systems, communications services, cloud providers, and couriers. Maintenance, outages, security incidents, disasters, government action, or provider unavailability may interrupt the service. We will use reasonable efforts to restore service, protect records, communicate material disruption, and provide the remedy applicable to an affected paid order.
A link to another website does not mean NowExpress controls that site's content or privacy practices. This does not reduce responsibility for a provider we selected to perform part of your NowExpress transaction.
24. Warranties and Responsibility
Healthcare outcomes vary, and no doctor, pharmacy, laboratory, or platform can guarantee that a treatment will work, a prescription will be issued, a test will produce a particular result, or an estimated delivery or turnaround time will always be met.
To the extent permitted by law, a party is responsible for loss that is a reasonably foreseeable result of its breach or wrongful act, subject to the facts and applicable law. Nothing in these terms excludes or limits liability or a remedy that cannot legally be excluded, including rights relating to defective or unsafe products, imperfect services, fraud, willful misconduct, gross negligence, professional accountability, privacy violations, personal injury, or death where the law does not permit exclusion.
You are responsible for loss caused by your fraudulent, unlawful, or deliberately harmful use, but you are not required to indemnify NowExpress for its own breach, negligence, regulated responsibility, or a matter for which the law does not permit shifting liability.
25. Complaints and Disputes
Contact the service-specific support address or admin@nowexpress.ph with your order, booking, or case reference and a clear description of the issue. We aim to acknowledge a complaint within two business days and provide an outcome or meaningful status update within seven calendar days. If investigation with a provider takes longer, we will explain why and keep you updated.
You may ask for supervisory review of a decision. Under the Internet Transactions Act framework, an internal redress process is deemed exhausted when an online consumer complaint remains unresolved after seven calendar days from filing. You may then, or whenever otherwise permitted, approach the DTI, FDA, DOH, NPC, PRC, a court, or another authority with jurisdiction. Contacting us does not waive those rights.
26. Changes, Suspension, and Ending Use
We may update these terms for future use when services, providers, or legal requirements change. The version accepted at purchase continues to govern that transaction unless a change is required by law or you agree to a lawful amendment. We will not use a later website update to remove an accrued refund, privacy, or consumer right.
You may stop using NowExpress at any time, subject to records that must be kept. We may end or suspend future access for safety, fraud, illegality, serious misuse, or service closure. Ending access does not cancel an accepted obligation, erase required records, or prevent either side from pursuing an existing right.
27. Governing Law
Philippine law governs these terms. A dispute may be brought before the court or authority that has jurisdiction under applicable law. Nothing here requires a patient or consumer to give up a venue, regulator, mediation process, or other remedy that cannot lawfully be waived.
If one provision is invalid or unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions continue to apply. A delay in enforcing a right is not automatically a waiver.

28. Your Rights Under Philippine Law
This policy is intended to work with the following Philippine laws, rules, and official guidance, as amended or replaced from time to time:
- Consumer Act of the Philippines (Republic Act No. 7394) - protects consumers against unsafe or defective products, imperfect services, deceptive practices, and unlawful warranty restrictions
- Internet Transactions Act of 2023 (Republic Act No. 11967) - sets duties for online merchants and preserves online consumer remedies
- Implementing Rules and Regulations of the Internet Transactions Act (Joint Administrative Order No. 24-03) - sets disclosure, invoice, cancellation, redress, and return requirements for online transactions
- Electronic Commerce Act of 2000 (Republic Act No. 8792) - recognizes electronic records, signatures, and transactions
- Data Privacy Act of 2012 (Republic Act No. 10173), its Implementing Rules and Regulations, and applicable National Privacy Commission issuances - protects personal and sensitive personal information
- Philippine HIV and AIDS Policy Act of 2018 (Republic Act No. 11166) and its Implementing Rules and Regulations - governs HIV testing, confidentiality of HIV-related information, counselling, and linkage to confirmatory testing and care
- Medical Act of 1959 (Republic Act No. 2382) - governs the lawful practice of medicine
- DOH-DILG-PhilHealth Joint Administrative Order No. 2021-0001 on telemedicine in individual-based health services - sets the national implementation framework for telemedicine
- Philippine Pharmacy Act (Republic Act No. 10918), including Section 37 on prescription records and patient medication profiles - governs pharmacists, prescriptions, dispensing, counseling, and the minimum retention of the pharmacy patient medication profile and prescription recording system
