Welcome to NowExpress! These Terms of Use (“Terms”) govern your access to and use of the NowExpress website, mobile applications, and related services (collectively, the “Services”).
1. Acceptance of terms
By using the Services, you confirm that you are at least eighteen (18) years old and capable of entering into a binding agreement under Philippine law, and that you will comply with these Terms and applicable laws and regulations.
2. Nature of services; no medical advice
NowExpress facilitates access to licensed medical professionals and may enable prescription fulfillment and delivery through licensed pharmacies and third-party couriers.
- The Services do not provide medical advice. Information on the site is for general informational purposes only.
- Licensed medical professionals are independent practitioners responsible for their medical judgment.
- Do not use the Services for emergencies. If you have an emergency, seek immediate in-person care.
3. User accounts
- Provide accurate, current, and complete information.
- Maintain confidentiality of your account credentials.
- You are responsible for activity under your account.
4. Privacy
Our Privacy Policy explains how we collect, use, and protect your information. By using the Services, you consent to the practices described there.
5. Online consultations & prescriptions
- Eligibility: not all conditions are suitable for online consultation; doctors may recommend in-person care.
- Provider relationship: consultations establish a direct provider–patient relationship with the consulting professional.
- Fulfillment: prescriptions are handled by licensed pharmacies in accordance with Philippine regulations.
- Delivery: delivery timelines may vary due to external factors; we are not responsible for courier delays outside our control.
6. Prohibited conduct
- Violating laws, regulations, or these Terms
- Impersonation or misrepresentation
- Interfering with platform security or operations
- Unauthorized access attempts
- Fraudulent or unlawful use
- Posting illegal, infringing, or harmful content
7. Intellectual property
All content on the Services is owned by NowExpress or its licensors and is protected by applicable intellectual property laws. You may not reproduce or distribute content without written permission.
8. Third-party links
Links to third-party sites are provided for convenience. We do not control those sites and are not responsible for their content.
9. Disclaimer of warranties
The Services are provided on an “as is” and “as available” basis without warranties of any kind, express or implied.
10. Limitation of liability
To the fullest extent permitted by law, NowExpress and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.
11. Indemnification
You agree to defend and indemnify NowExpress and its affiliates from claims arising out of your violation of these Terms or misuse of the Services.
12. Governing law & dispute resolution
These Terms are governed by the laws of the Republic of the Philippines. Disputes shall be resolved in the appropriate courts located in Manila, Metro Manila, Philippines.
13. Changes to terms
We may update these Terms from time to time. Continued use of the Services after changes means you accept the updated Terms.
14. Severability
If any provision is held invalid or unenforceable, the remainder will remain in effect.
15. Entire agreement
These Terms and our Privacy Policy constitute the entire agreement regarding the Services.
